Processing of Personal Data – Information Clause (GDPR)

In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, OJ L 119, 4.5.2016, p. 1), hereinafter referred to as “GDPR”, please be informed that:

  2. Your personal data will be processed by the Controller for the purposes of handling enquiries, processing orders and invoicing resulting from concluded contracts and consents granted.
  3. Your personal data will be processed pursuant to the provisions of the GDPR:
    • Article 6(1)(a) – consent granted for the processing of personal data;
    • Article 6(1)(b) – performance of contracts concluded between the Controller and entities executing tasks on behalf of the Controller;
    • Article 6(1)(c) – processing is necessary for compliance with a legal obligation to which the Controller is subject.
  4. In connection with the processing of your data for the purpose specified in point 3, the recipients of the data may include:
    • public authorities and entities performing public duties acting under applicable provisions of law;
    • entities with which the Controller has signed relevant data processing agreements.
  5. Your personal data will be stored for the period necessary to achieve the specific purposes set out in point 3, and thereafter for the duration and to the extent required by generally applicable law.
  6. In connection with the processing of your personal data, you have the following rights:
    • right of access to personal data, including the right to obtain a copy of such data;
      right to request rectification (correction) of personal data;
    • right to request erasure of personal data (the “right to be forgotten”);
    • right to request restriction of processing of personal data;
    • right to data portability and updating of data;
      right to object to the processing of data.
  7. Where the processing of your personal data is based on consent to the processing of personal data (Article 6(1)(a) GDPR), you have the right to withdraw that consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
  8. If you become aware of any unlawful processing of your personal data, you have the right to lodge a complaint with the supervisory authority competent for personal data protection matters – the President of the Personal Data Protection Office.
  9. Where the processing of personal data is based on the consent of the data subject, the provision of your personal data to the Controller is voluntary.
  10. The provision of your personal data is mandatory where the legal basis for processing personal data is a provision of law or a contract concluded between the parties.
  11. Your personal data will not be processed by automated means and will not be profiled; the data will not be transferred to third countries or international organisations; should any such transfers take place, you will be informed accordingly.
